Draft - not yet reviewed by a lawyer. This describes how Payly actually behaves today and is written in good faith, but it has not had legal review and is not yet a binding agreement. It must be reviewed before Payly takes on real customers.

Terms of service

The agreement between you and Payly: what the service provides, what you are responsible for, and how either side can end it. Last updated 21 August 2026.

1. The service

Payly provides website building, hosting and storefront tools, operated by WPPlugin LLC. The platform is provided free of charge. There is no paid tier, no trial, and no commission on your sales.

Payment processing is performed by Stripe or PayPal under their own agreements with you. Payly is not a payment processor, is not a party to those agreements, and never holds your money.

2. Your account

You are responsible for keeping your credentials secure and for everything done by anyone you invite to your team. Tell us promptly if you believe your account has been accessed by someone else.

You must be old enough to enter a contract where you live, and you must give accurate account information.

3. Your content and your customers

You own what you publish and the customer data your store collects. We do not sell it, do not use it for advertising, and do not use it to compete with you.

You grant us only the permission needed to run the service: to store, copy and publish your content so visitors can see it.

Where your store collects personal data, you are the data controller for it and are responsible for having a lawful basis to do so.

4. Acceptable use

You may not use Payly to sell or publish:

Anything illegal where you or your customers are.
Material that infringes someone else's rights.
Malware, phishing pages, or anything designed to deceive.
Content that harasses or endangers people.

You may not attempt to break, overload or circumvent the service, or use it to send bulk unsolicited email.

We may suspend or remove a site that breaches these rules. Where it is safe and lawful to do so, we will tell you why and give you a chance to put it right first.

5. Payments

Funds flow from your customers directly into your own Stripe or PayPal account. Payly never holds, disburses, or has a claim on them.

Refunds, chargebacks and disputes are between you, your customer and your processor. We cannot reverse a payment on your behalf, because we never had it.

You are responsible for the tax on your sales, and for the accuracy of any tax settings you configure.

6. Availability

We work to keep the service running and fast, but it is provided as-is and without a guaranteed uptime commitment. We may change or discontinue features, and will give reasonable notice before removing something you depend on.

7. Liability

To the extent the law allows, Payly is not liable for lost profits, lost sales, lost data or indirect losses. Because the service is free, our total liability to you is limited to the amount you have paid us, which is nothing. Nothing here limits liability for death, personal injury, or fraud.

8. Ending the agreement

You may stop using Payly and delete your account at any time. Export anything you want to keep first - deletion removes your sites and their content.

We may suspend or close an account that breaches section 4, or where we are required to by law. If we discontinue the service entirely we will give you reasonable notice and time to export.

9. Changes to these terms

If we change these terms we will update the date above. For significant changes we will tell you by email before they take effect. Continuing to use Payly after that means you accept them.

10. Governing law

These terms are governed by the laws of the state in which WPPlugin LLC is registered, and disputes are subject to the courts there.
